Please read these Terms of Service ("Terms") carefully before using Dusty Compass's website or engaging our hotel growth consulting services. By accessing our website or engaging our services, you agree to be bound by these Terms.
1. About Dusty Compass
Dusty Compass is a hotel growth consulting and digital marketing service operated by Mohit Swami, providing services including social media management, direct booking system development, content creation, SEO, and hotel growth strategy to boutique and mid-scale hotels across India.
2. Services Offered
Dusty Compass offers the following services:
- Starter Plan: Foundation social media management including Reels creation, GMB optimisation, review systems, and WhatsApp AI setup
- Growth Plan: Comprehensive growth including website rebuild, direct booking funnel, CRM setup, and weekly performance calls
- Scale Plan: Full-service hotel marketing including paid advertising, full CRM, dedicated management, and all Growth Plan features
- 1-Week Action Trial: A one-time entry service including one Reel, a GMB audit, and review system setup
- Website Redesign: A one-time hotel website rebuild project
3. Payment Terms
- All prices are in Indian Rupees (INR) and inclusive of applicable GST unless stated otherwise
- Monthly plans are billed in advance at the beginning of each billing cycle
- Payments are processed securely through Razorpay
- One-time services (1-Week Trial, Website Redesign) are payable upfront before work commences
- Failed payments may result in temporary suspension of services
4. Cancellation and Refund Policy
Monthly Plans:
- You may cancel your monthly plan at any time. Cancellation takes effect at the end of the current billing month
- We do not offer mid-month refunds for monthly plans
- Notice of cancellation must be provided via WhatsApp or email at least 7 days before your next billing date
One-Time Services:
- For the 1-Week Action Trial and Website Redesign: if work has not commenced, a full refund may be requested within 24 hours of payment
- Once work has commenced, refunds are not available for one-time services
5. Client Responsibilities
For effective delivery of services, clients agree to:
- Provide timely access to social media accounts, Google My Business listings, and website credentials as required
- Provide high-quality property photos, videos, and relevant hotel information when requested
- Respond to Mohit's messages and calls within a reasonable timeframe (48 hours)
- Approve content within the agreed timelines to avoid delays in posting schedules
- Not engage other social media or marketing agencies for the same scope of services during the engagement without prior discussion
6. Intellectual Property
- Content created by Dusty Compass specifically for your hotel (Reels, graphics, captions) is owned by you upon full payment
- Dusty Compass retains the right to use content examples (with appropriate anonymization) in its own portfolio and marketing materials unless you request otherwise in writing
- Our proprietary strategies, templates, systems, and frameworks remain the intellectual property of Dusty Compass
7. Results Disclaimer
While we have a strong track record of delivering measurable results for hotel clients, Dusty Compass cannot guarantee specific outcomes such as a particular number of direct bookings, follower growth, or revenue increase. Results depend on factors including your property's location, room inventory, pricing strategy, and market conditions.
Testimonials and case studies on our website represent real client experiences but are not guarantees of identical results for all clients.
8. Confidentiality
Both parties agree to maintain the confidentiality of sensitive business information shared during the engagement. Dusty Compass will not share your hotel's financial performance data, booking figures, or proprietary information with third parties without your consent.
9. Limitation of Liability
Dusty Compass's total liability for any claims arising from our services shall not exceed the fees paid by you in the 3 months preceding the claim. We are not liable for any indirect, consequential, or incidental damages.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the jurisdiction of courts in Rajasthan, India.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated to active clients via email or WhatsApp. Continued use of our services constitutes acceptance of the updated Terms.
